Agreement to terms
These Terms of Use (“Terms”) govern your access to and use of the Zeye mobile application (the “App”) provided by Zeye (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
Description of the service
Zeye offers tools to create geometric, paper-style artwork from your images, including editing, local saving, and export features. Optional virtual currency (“coins”) or other in-app purchases may be available for certain premium actions. Features may change over time.
Eligibility
You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements (including Apple’s age requirements for the App Store). If you use the App on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Your content
You retain ownership of content you import or create, subject to the rights you grant us below. You are responsible for ensuring you have the rights to use any images or materials you provide. You must not upload or generate content that is unlawful, infringing, harassing, hateful, or otherwise objectionable.
You grant us a limited, non-exclusive license to process your content solely as needed to operate and improve the App on your device (for example, rendering and storing projects locally), unless you choose to export or share content through other services.
License to use the App
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, in accordance with the App Store rules and applicable law. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the App, except where such restrictions are prohibited by law.
In-app purchases
Purchases are processed by Apple. Prices, billing, and refund rules are subject to Apple’s terms. Virtual currency is licensed for use only within the App and may not be transferred or redeemed for cash, except as required by law. We may change offerings or pricing with reasonable notice where appropriate.
Acceptable use
- Do not misuse the App, interfere with other users, or attempt unauthorized access to our systems.
- Do not use the App to violate intellectual property, privacy, or other rights of third parties.
- Do not use automated means to access the App in a way that imposes an unreasonable load or circumvents security.
Disclaimer of warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR IN-APP PURCHASES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
Indemnity
You agree to defend and indemnify us and our affiliates against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your content, your use of the App, or your violation of these Terms, except to the extent caused by our willful misconduct.
Termination
We may suspend or terminate your access to the App if you breach these Terms or if we discontinue the service. You may stop using the App at any time. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
Governing law
These Terms are governed by the laws applicable in your primary place of residence or, where permitted, the laws we designate in a separate notice, without regard to conflict-of-law principles. Courts in those jurisdictions may have exclusive jurisdiction over disputes, unless mandatory consumer protections require otherwise.
Changes
We may modify these Terms from time to time. We will post the updated Terms in the App or otherwise notify you as required. Your continued use after the effective date constitutes acceptance of the changes.
